LOHA Dating Terms of Use **Effective Date: October 28, 2025** ### WELCOME & ACCEPTANCE OF TERMS Welcome to LOHA Dating (“we,” “us,” or “our”). By accessing or using our website, mobile application, or services (collectively, the “Platform”), you agree to be bound by these Terms and Conditions. Please read them carefully before using LOHA. --- ### 1. DEFINITIONS * **Company** is the exclusive owner and operator of loha.dating (the “Website”, the “Site”, the “Company”, “we”, “us”). The platform's name is LOHA Dating, while the business trading name is **AFFINITY ONE AUSTRALIA**. * **Services** refers to your use of the Platform for any purpose, including creating a profile, browsing, communicating, and utilizing premium features such as Credits, Premium Membership, Boosts, and the **Deepsyke AI Dating Oracle Coach**. * **Credits** is the virtual, in-app currency purchased from the Company and used exclusively within the Services. * **User Content** stands for the material that you publish on the Site or send to other members. * **Affinity Zones System**: This proprietary system includes the four neurochemical types (SS, SD, DS, DD) and the eight dating archetypes (Mystic, Maiden, Queen, Huntress, Magician, Knight, Warrior, King). --- ### 2. ACCOUNT REGISTRATION AND ELIGIBILITY * **2.1. Acceptance of Terms:** By registering, accessing, or using LOHA Dating, you confirm that you are at least **18 years old** and agree to comply with these Terms. If you do not agree, please do not use our services. * **2.2. Account Information:** You must provide accurate, truthful, and complete information when creating an account. **This includes accurate gender and Date of Birth (DOB) as this data feeds into the neurochemical compatibility algorithm, which will not work properly with wrong information**. You are responsible for maintaining the confidentiality of your login credentials. * **2.3. Basic Membership:** Basic membership is free upon sign-up and includes an initial allocation of **100 free Credits**. Basic members are entitled to **browse and message other free members**. * **2.4. Account Suspension:** LOHA Dating reserves the right to suspend or terminate any account found to be violating these Terms, including but not limited to, the violation of the philosophy of **respect, boundaries, consent, and grown-up communication**. There is also **zero tolerance for abuse** on the platform. --- ### 3. SUBSCRIPTION, CREDITS, AND PAYMENTS * **3.1. Credit Value and Use:** **10 Credits are valued at $1 AUD**. Credits can be used to buy gifts, stickers, Boosts, or to purchase Premium Membership. * **3.2. Premium Membership Benefits:** Premium Members can **browse and message everyone**, access **Video calls, Phone calls**, **Use Deepsyke AI**, **See who liked them**, and access the **Encounter feature (quick swipe)**. * **3.3. Boosts:** Boosts are available for a set Credit price and provide profile visibility for a fixed duration of four (4) hours. * **3.4. Premium Duration and Discount:** Premium Membership can be purchased for durations including **Daily, Weekly, Monthly, 6 months, or Yearly terms**. Longer terms are offered at a progressively discounted rate. Purchasing higher tier credit packages will also provide bonus credits. * **3.5. Payment Processing:** All payments are processed securely via Stripe, a third-party payment processor. You are subject to Stripe’s terms and conditions. * **3.6. Refund Policy:** All Credit and Premium Membership purchases are non-refundable, except as required by Australian Consumer Law. If you believe there has been a mistake by the Company or the system, you can contact service support and apply for a refund under special circumstances, which will be reviewed at the Company’s sole discretion. * **3.7. Pricing Changes:** LOHA Dating reserves the right to change pricing or plan features at any time with prior notice. --- ### 4. USER CONTENT AND CONDUCT * **4.1. User Conduct:** You agree not to: * Use LOHA Dating for any illegal or harmful activities. * Harass, abuse, or defame other users. * Post offensive, obscene, or sexually explicit content. * Impersonate another person or entity. * Upload viruses, spam, or malicious software. * Fail to uphold the platform's core values, which include **cultivating an open minded, switched on and inclusive, non-judgemental community**. * **4.2. Content Removal:** We reserve the right to remove content or terminate accounts that violate our policies. * **4.3. Content Ownership:** You retain ownership of the content (e.g., photos, messages, profile information) you upload to LOHA Dating. By posting content, you grant LOHA Dating a non-exclusive, worldwide, royalty-free license to display and distribute that content as part of the Service. --- ### 5. DEEPSYKE AI DATING ORACLE COACH & INTELLECTUAL PROPERTY * **5.1. Feature Access and Function:** The Deepsyke AI Dating Oracle Coach is a premium feature accessible by searching for its profile and initiating a chat. It is designed to give you specific advice on your neurochemical pattern and compatibility tips. It can be used as a dating coach for advice, conversation ideas, approach ideas, and psychology insights. **It can also be used as a general AI, though it does not process long responses or access real-time information from the internet**. * **5.2. Data Accuracy:** The advice provided by the AI relies on the data you input. The quality of advice is contingent on the accuracy of the data you provide, especially your gender and Date of Birth (DOB). * **5.3. Guaranteed Privacy:** No data used in the conversation is stored anywhere except in the temporary server. If you delete your chats with Deepsyke, the data is permanently deleted from the system. **Deepsyke will not access information from your profile besides the metrics needed for a type calculation and will not access anyone else's**. No data is gathered or used by LOHA Dating or any third party sites for any purpose. * **5.4. Intellectual Property & Disclaimer:** The four neurochemical types (SS, SD, DS, DD) and the eight dating archetypes are part of the **Affinity Zones System and Deepsyke AI, which were developed by Leo Kendrick. He owns all the intellectual property and copyright rights to this system**. The system is based on 14 years of research into neurochemical types. **This system is intended only as an educational tool and should not substitute for professional or medical advice**. * **5.5. Disclaimer of Liability:** LOHA Dating is **not responsible** for what you chat with Deepsyke about, the responses of the AI, or your actions that proceed from those chats. **There is no professional indemnity in this regard.** **The user does so at their own discretion and takes full responsibility for their actions.** **Deepsyke is not a romantic GF/BF companion and does not engage in sexually suggestive or offensive conversation**. There is no legal responsibility regarding the user’s responses and actions in relation to Deepsyke. --- ### 6. SAFETY, PROFILE INTEGRITY, AND LIABILITY * **6.1. Safety Notice:** Always act with caution when communicating or meeting other users. LOHA Dating does not conduct criminal background checks and is not responsible for user behavior offline. When meeting in person, **tell a friend where you're going, arrange your own transportation, and meet in public places for the first several dates**. * **6.2. Profile Legitimacy:** We are not responsible for profile generation and cannot guarantee any profile is legitimate, including bio, photos, or chat interaction. This is up to the user to discern. **We do not check profiles unless they are reported, so you are the first line of defense**. Watch for red flags like profiles with only one or two photos, immediate requests to move to other platforms, and stories that don't add up. * **6.3. Financial Safety:** **Never send money, share financial information, or accept requests for gifts or financial assistance from someone you haven't met in person**. * **6.4. Reporting:** If you suspect a profile is fake, illegitimate, deceptive, a scam, or abusive in their conduct, please **report the user immediately, block them**, or contact service support, and we will remove the profile if it matches your concerns. --- ### 7. TERMINATION, WARRANTIES, AND LIABILITY * **7.1. Termination by Us:** We may suspend or terminate your account if we believe you have violated these Terms. We also reserve the right to immediately suspend or terminate your access to any of the Services, without notice, for any reason or no reason. * **7.2. Termination by You:** You may also delete your account anytime through your profile settings. * **7.3. Disclaimer of Warranties:** LOHA Dating provides Services on an “AS IS” and “AS AVAILABLE” basis. We make no warranties regarding the accuracy, reliability, or availability of the Platform or its users. * **7.4. Limitation of Liability:** LOHA Dating is not responsible for any damages arising from: * The actions of other users; * Technical issues, interruptions, or data loss; * Any personal or emotional outcomes resulting from interactions through the Platform. --- ### 8. AUSTRALIAN JURISDICTION AND CONTACT * **8.1. Governing Law:** These Terms of Use are governed by and construed in accordance with the laws of Australia, specifically the State of South Australia. The parties agree to submit to the exclusive jurisdiction of the Courts of Australia. * **8.2. Australian Consumer Law (ACL):** Nothing in these Terms attempts to exclude, restrict, or modify any non-excludable condition, guarantee, warranty, or right under the ACL. Our liability for breach of a non-excludable guarantee is limited to supplying the services again or paying the cost of having the services supplied again, at our option. * **8.3.
